Where We Now Stand

I need to begin this with a notification. I am not even going to attempt a regular Friday Talking Points column today. We're so far from normal that it just wouldn't work -- that's what I decided when sitting down to write, at any rate.

Where we stand as a nation right now is that Joe Biden is almost certainly going to become the next president of the United States. Donald Trump is almost certainly not going to have a second term in office. We're only "almost" certain because the vote count in several states is so close that they haven't officially been called for one candidate or the other yet.

But the writing is on the wall, at this point. As I write, Biden is ahead in Arizona, Nevada, Georgia, and Pennsylvania. Trump is ahead in North Carolina and Alaska. But Trump needed pretty much all of these states to win. Biden only needs Pennsylvania, or a combination of any two of the others. And he's currently ahead in four of them.

Ironically, if the states finish as they are right now, this would give Biden 306 Electoral College votes, which is exactly the same number Trump should have won (there were a few "faithless electors," so he officially only ended up with 304). And please remember, according to Trump, his 2016 victory was a "landslide" -- the biggest blowout in all of American political history. Neither is remotely true, but those quotes are going to be a lot of fun to throw around in the next few months, that's for sure. Trump can't run down Biden's win as somehow insignificant when the two men both won by the exact same amount, in other words.

Trump, of course, is not going gently into that good night. Yesterday, he appeared at the White House briefing room podium and spouted so many lies and conspiracy theories that the "big three" broadcast television networks all cut away from his remarks, so they could debunk his lies instead. That is an astonishing commentary in and of itself. Stephen Colbert was so deeply affected by Trump's remarks that he gave the grimmest monologue I have ever seen on late-night television, in response.

Colbert's right. For all the times Trump has baselessly thrown the word around, this is nothing short of a disgrace. We all knew Trump was going to be a sore loser, and he has proved this continually ever since Election Day. He was so convinced that he could not possibly lose to Joe Biden that he is now incapable of facing the truth. More Americans -- four million, as of this writing -- voted for Biden than voted for Trump. Biden is on his way to win five states Trump had carried in 2016: Wisconsin, Michigan, Pennsylvania, Georgia, and Arizona. Trump has spewed lies and conspiracy theories about why the election was "stolen" from him, without a shred of an iota of a scintilla of proof. There is no proof to be found, either. All that "voter fraud" Republicans like to get worked up about just does not happen in the real world. It just doesn't. Maybe a handful of isolated cases here and there, but nothing on the scale that would be necessary to throw any election, even at the state level.

There actually was one instance of an attempt at widespread voter fraud this week, but it's unhelpful to Donald Trump because this fraud was attempted by Republicans. A call went out in Pennsylvania for Republicans to mail in their ballots after Tuesday, because someone was apparently confused about the rule that ballots would be accepted up to three days after Election Day. To be clear: ballots have to be postmarked on or before Election Day to count. Mailing a ballot in afterwards is an attempt to break the law, plain and simple. And yet that's what Republicans were told to do. In Pennsylvania. This means that the only attempt at that widespread voter fraud Republicans so dearly love to complain about actually came from within their own party.

Trump's claims are ridiculous for another reason, too. Biden did not win in a blowout. There was no real "blue wave" that washed over any of the other down-ballot races. Democrats lost seats in the House, they have so far failed to take control of the Senate (which is still technically possible with the Georgia runoff races, but highly unlikely), and they lost seats in state legislatures that they had been optimistic about. In other words, other than the presidential race, it wasn't a very good election for Democrats. So if you assume that Trump's grand conspiracy is true (without one jot or tittle of evidence, mind you), then why would Democrats not have conspired to win all the other races too? It makes no sense, in other words, not that it ever did.

Trump's got nothing, at this point. He still thinks the courts will somehow magically save him, but he is wrong. There's a very simple reason for this: "Throw out the results and declare me the winner" is not an actual legal strategy. You need to base a lawsuit on facts, and Trump has none to work with. It's doubtful at this point whether any of the flurry of cases Trump has filed will even make it to the Supreme Court at all, because Trump's lawyers have only managed to complain around the edges. They wanted more vote-counting observers. They wanted the observers to stand closer. They wanted the count to halt, but by the time it even got to the judge in most states, the counting was already done. They want certain ballots disallowed, but there just aren't enough of them to make a difference. In the few instances where they are daring to claim actual fraud or improper handling of ballots, they have no evidence whatsoever. Political blustering is not evidence, obviously, and that's all they really have to work with. And now, to get the election results overturned will mean getting multiple states overturned. Which just isn't going to happen.

We still have over two months before Trump leaves office. He could -- and probably will -- do further radical damage to democracy and the American system of government, on his way out the door. I would be willing to bet that Trump will never call Biden up to concede the election, and furthermore that Trump will not participate in any of the transfer-of-power ceremonies on Inauguration Day. There is just no way that Trump is going to sit and watch Biden make a speech, or watch him be sworn into office. Trump will likely watch from Mar-A-Lago instead. Donald Trump is the most petulant man-baby ever to occupy the Oval Office, and he's going to leave office with a tantrum for the ages. That's my guess, at any rate. But at this point, it seems like a pretty safe bet.

Trump is already doing further damage to the Republican Party. He and his offspring have demanded that all Republicans get on board Trump's "Conspiracy Express" crazy train, and several prominent Republicans have obliged -- to their everlasting shame. There is indeed one candidate who is trying to steal this election but it's not Joe Biden, and history will record what will happen next. Standing with the president's unhinged and baseless conspiracies is an attack on democracy itself, not some sort of profile in courage. The whole world is watching, and the names of those willing to feed Trump's fantasies will forever be recorded. The names of those who stand silent will also be condemned forever, because as Colbert pointed out (in Latin), silence is consent. Anyone not now denouncing Trump's raving lunacy is consenting to it, period.

As of this writing, Joe Biden still doesn't officially have the Electoral College votes to win. We're going to have to wait a bit longer for that to happen, although Pennsylvania will likely be called within hours (not days, in other words). That would put Biden over the top, even without Arizona being called. We will have to wait a bit longer for all the other states to report their final vote totals, and then there will likely be recounts (in at least Wisconsin and Georgia). It could be weeks before the final results are truly known -- just as many predicted before Election Day dawned.

Of course, some of this could have been fixed. But Republicans refused to do so. There's a reason why some states finished a lot earlier than others, and that reason is that some states allow mail-in and early-voting ballots to be counted before Election Day. This makes all kinds of sense, obviously. But in others -- with Republican-held legislatures -- this is not allowed. Republicans can try to hide behind their nonsensical claims of fighting "voter fraud," but this election has really stripped that away. What Republicans want is pretty obvious -- to make it as hard as possible for Democrats to vote. They fought early voting, they fought curbside voting, they fought mail-in voting, they fought to limit drop boxes -- and now they have the temerity to complain that the process takes too long. You can't have it both ways, guys. Either you make it easy to have a final count on Election Day, or you have to accept that it will take longer. But you just can't have it both ways.

Donald Trump is well on his way to becoming the thing he fears the most: a loser. He will join the ranks of one-term presidents like Jimmy Carter and George H. W. Bush. He will not have a second term. He can still do some damage on his way out the door (such as pardoning himself and his whole family), but his time is almost up. He will then become a private citizen once again, and as such will no longer be protected by his office. He will have to answer all those lawsuits and state-level charges that have been waiting, and even a federal pardon won't help him with any of it. His tax forms will likely be revealed. His Twitter account will be subject to the rules that all non-officeholders have to follow. He will be relegated to the sidelines, whether he likes it or not. He could follow the dream of setting up his own "Trump TV" media channel, where he could rant and rave to his heart's content, but that will be the sum total of his power. He will forever complain that the election was "stolen" from him, without offering any proof whatsoever.

But America will soon see him for exactly what he is -- a big fat loser. And a sore loser, as well. That will be his legacy, no matter how much he may hate it. And that's an entirely fitting end to his presidency.

    I think he'll also talk about how well the counting has been going and that the whole process is a shining example of how well American democracy works. It should be a moment of pride for all Americans. It has really been a pleasure to watch!

    The reason I don't want it to be Preet Bharara (though I do hope Biden reappoints him to SDNY) or Sally Yates (and I'd love to see her back at DoJ in charge of one of the departments there, or possibly White House Counsel) is because when they indicted Trump, they'd be accused of vengeance.

    And we have yet another example of how hard it is to avoid normalizing this man and his presidency. The statement is incorrect. The correct observation is

    Because try to name another one who could possibly merit that description. I am not looking forward to future history textbooks or 'Our Presidents' type books for young readers, that will try to make Trump out to have been just another of America's presidents. He is off the charts in ways that even Harding or Nixon or Reagan (in their different ways) never came close to approaching.

    What I really thought, about halfway through, was that it was all so normal. Any politician from the past 40 years could have given that speech (except for the pandemic references). And that's the whole point.

SNL could do that one justice, that's for sure...

    Anyway, like I said, a damn fine speech. We've waited all week long for that speech, and Joe delivered it well.

    I'll give it a go on at least two of your issues:

    1) Even Biden admits now that what he did on the crime bill was a mistake, and that criminal justice reform will be a top priority of his administration. Plus, with so many states now legalizing marijuana, A lot of the racial disparity regarding drugs and incarceration will now start to ameliorate.

    2) Another top goal of Biden's will be improving and expanding the ACA, especially with a public option which should have been included in the first place. If people are allowed to choose a public option, then health insurance tied to employment may simply whither away and die a natural death all on its own accord.

    I ran into an older white guy at work yesterday and we had a very limited chat about the election which proved my point about Democrats and the economy.

    This man told me that Biden will be bad for the economy, raise everyone's taxes and send US business to Canada.

    I told him the funny thing is that Republicans always drive the economy into ruin and Democrats are left to clean up the mess. We didn't have enough time to persuade each other but, he was firmly in the grasp of the Republican cult of economic failure. I think he is quite representative of a large chunk of conservative Canada.

    Had Trump won - and let's stipulate that if he didn't always get in his own way all the time, he would have won - I would have warned you that it wouldn't be a good idea to move here, sorry to say.

    Actually, not. This is not a private space. It wouldn't have mattered if it were a really great joke involving lynching, the Armenian genocide, Indian massacres, the Holodomór, or any other murdering spree of humankind's collective past. Without the context, which I clearly didn't get and then asked for, that "joke" is merely an appalling statement.

    Though many here have apparently seen the movie, I suspect I am not the sole reader of the blog who hasn't. I get that you don't care. Bully for you. You got rights, so bully on.

    Even given the context, I don't think the joke stands, but that is just my opinion, which you are free to continue to airily dismiss. SBC uses his art to expose just how shallowly covered bias, prejudice, and hatred are; that he can so easily get ordinary people to join in is a frightening commentary on our society. That's his point and you just exemplified it.

    Truly, a group of "Adults" that has "evolved" beyond the need to tolerate other opinions or have consideration for others' lived life experiences holds no appeal for me. In my view, adults don't instantly reach for puerile putdowns; they engage in discussion.
