Use Reconciliation To Lower Prescription Drug Prices

At this juncture in time, what was once seen as a radical suggestion seems more and more to now be a very smart course of action. This is far from ideal, since the original plans would have been far, far better... but we are where we are. So perhaps it is time for Democrats in Congress to consider using the budget reconciliation rules in the Senate to achieve only one of their stated objectives. And there is no more pressing concern for the voters than limiting pharmaceutical companies from their continual greed when it comes to setting the price of their wares for the American public. Lowering prescription drug prices via reconciliation would chalk up an enormous political win for Democrats, heading into the midterm campaign season.

Obviously, I would not have said nor supported such a radical idea a few months ago. Back then the possibility still existed of accomplishing a whole lot more of President Joe Biden's agenda within a single bill. Those hopes have now been dashed by Senators Joe Manchin and Kyrsten Sinema, though. "Build Back Better" is just not going to happen -- or, even if something called that does manage to limp through the Senate, it will be nowhere near as comprehensive as what was initially contemplated.

This, of course, means throwing in the towel (for now) on all sorts of other enormously good ideas -- such as tackling climate change in a big way. And all the rest of it, too. But again, that's where we are right now. A few of those things might (just might, mind you) be eventually acceptable to Manchin and Sinema, but chasing that wild goose would take up far too much time. As indeed it already has.

Per the Senate parliamentarian, only one budget reconciliation bill is allowed for any one year's budget. This is why so many things were stuffed into Build Back Better in the first place. It included all the things that had to be excised from the infrastructure bill to make it bipartisan, too. There was only one train leaving the station, so everyone wanted to be sure their pet projects or issues were on board.

But that train is about to leave, for good. But all is not lost -- there's another train warming up on the platform. The Build Back Better bill was supposed to "reconcile" with last year's budget. We are still running the federal government under that budget, even though the federal fiscal year started in October, because no new budget bill has passed for this year. We're operating under "continuing resolutions" which merely punt the budget ball down the road by approving the continued spending under last year's budget rules. But this may be about to change. The clock is about to run out on the latest of these, and Congress is feverishly attempting to work out a deal so they can pass this year's budget instead of just punting the ball once again. There is no guarantee of success -- if they get close to the deadline, they may well punt again. But if they do manage to get an actual budget passed, then the budget reconciliation train for last year will have already left the station. Sure, there'd be another one warming up on the platform for this years' budget, but it'd still be a gigantic lost opportunity. Democrats would have wasted their one reconciliation opportunity for the year and failed to pass anything. Which seems not only a shame but also political malpractice in an election year where Democrats are facing steep odds.

So why not jettison all the other ideas for now and concentrate on the one that is the most wildly popular with the public? And that issue is pretty clearly addressing the problem of high prescription drug prices. Instead of leaving voters disappointed at a lost opportunity, Democrats could score a very solid victory instead. And then they'd always have a chance to pass another budget reconciliation bill if a real budget for the current year actually passes. This would allow the continued wooing of Manchin to get on board some form of Build Back Better (whether this effort was ever successful or not).

Some Democrats in the House are already pushing the idea of stripping the prescription drug reforms out of the bigger effort and attempting to pass it as a standalone measure. They just sent a letter (signed by 40 House Democrats) to their own leadership in both chambers pressing the issue:

We write to you today urging you to take legislative action as swiftly as possible to lower drug prices. For years, people have sent us to Washington on the promise that we end Big Pharma's monopoly control over prices and provide patients with much needed relief. We must make good on that promise -- and we have the ability to do so.

. . .

President Biden supports this plan. We support this plan. Every Democratic member of the U.S. Senate supports this plan. And most importantly, the American people support this plan. It is time to enact it into law. Already this year, drug corporations have raised prices on more than 400 drugs. Action can't happen soon enough to make medicines affordable for the millions who need them.

We cannot overstate the paramount urgency of fulfilling the promise of lowering drug prices now for the American people. They're counting on us.

Salon notes the important context for this letter:

The letter came after pharmaceutical companies hiked prices on hundreds of medications to start the year. A recent report from the patient advocacy group Patients for Affordable Drugs found that drug companies have increased prices on more than 550 drugs, including 183 drugs whose prices were raised by $100 or more, and 118 drugs that now cost more than $5,000. Pfizer alone raised prices on 125 drugs, more than any company, even as it shattered profit records thanks to $36 billion in sales from its widely-used COVID vaccine.

Not only is the idea of fighting high prescription drug prices wildly popular with the public -- and wildly popular even among Republican voters -- many members of Congress regularly report that this is the top priority raised with them when they conduct townhalls or otherwise speak with their constituents. People desperately want to see reform happen.

Of course, Big Pharma's got some awfully big (and deep) lobbying pockets. They've essentially purchased many a member of Congress. Their biggest score in this regard is without a doubt Kyrsten Sinema. The House, when the budget reconciliation effort began, tried to pass a much beefier version of it that would have saved $450 billion over 10 years, but Pharma's bought-and-paid-for caucus balked and the version that wound up in Build Back Better (after Sinema took a final few bites out of it at the very end) would only save $80 billion. Still, it's a big step in the right direction that can be expanded upon later.

The best thing about the compromise plan (the one even Big Pharma's lackey's were forced to swallow... one might call it a bitter pill for them, in fact) was that it came complete with a bumpersticker slogan for Democrats to run on: limiting the price of insulin for people on Medicare and private insurance plans to only $35 a month. That's a winning issue to trumpet on the campaign trail.

Under reconciliation, only 50 votes are necessary in the Senate to pass such a bill. Raising revenue to pay for the plan would complicate the issue, but if that was handled delicately enough it is certainly possible that even some Republicans might be enticed into voting for it. If Democrats signal loudly (which they should) that this will be a major campaign issue in the midterms, Republican senators from purplish or blue states who are up for re-election might think twice about voting against it. And peeling off just one or two of them would mean Sinema and/or Manchin would become completely irrelevant to the process.

Tackling the greed of prescription drug companies is a lot easier to oppose when it is tucked within a bigger bill, since any politician can say: "No, no -- it's this other thing in the bill that I can't vote for." By presenting it as a standalone bill, that position becomes impossible.

If the reconciliation train is leaving the station anyway (with the passage of a new year's budget), then why not make this attempt? Build Back Better is simply not going to pass before that budget is in place. But this could. The choice could easily be seen as losing the reconciliation opportunity by letting it lapse without passing anything versus passing just one tiny bit of what was envisioned. It's pretty easy to see which of these options is the better one. So even though a month or two ago it would have seemed like a radical (and disappointing) idea, and one that accomplished very little compared to what could have been accomplished, at this point it boils down to the choice of doing one very popular thing versus going to the voters completely empty-handed.

Every Republican candidate for Congress should be in the position of having to say that they think taxpayers should pay top dollar per pill every time the government buys medication, and that consumers should also shoulder the burden of overpriced medication. They can't say that they're just protecting "pharmaceutical integrity."

    Further, as Solomon wrote, in the email, Kent “relayed to higher-ups that he had confirmed with Ukrainian prosecutors that Burisma officials had paid a $7 million ‘bribe’ to make one of the cases against the company disappear. The bribe was allegedly paid at a time when Hunter Biden was serving on the Burisma board, a job that landed his firm more than $3 million from the Ukrainian energy company.”

    As per the norm, Democrats step on their own wee wees in pursuing their hate filled bigoted attacks on President Trump..

    My beef is that, rather than look out for the welfare of the child, which should be her ONLY concern, this teacher let her ideology override her primary duty...

    I am not looking for support to blame "teachers" in general.. Gods know that there is plenty of blame to be placed on teachers in general..

    I simply point out that THIS particular teacher in THIS particular case frak'ed up..

    And a child almost died because of her being a Democrat first and being a teacher second..

    what i think doesn't matter; there are legal requirements. just like cops have to follow due process in search, questioning, arrest, evidence gathering, and so forth, school officials also have to follow procedure. if they didn't follow the regulations and someone is hurt as a result, they're at fault. if they followed the rules and bad things happened anyway, that's a different problem.

    you don't share with the parent and the child commits suicide, it's your fault. you do share with the parent, and they fly into a rage and kill the kid, it's your fault. there's just no way to anticipate every potential situation.

    I don't think the suicide attempts were a stunt. I think the parents reaction and bringing in the Child & Parental Rights Campaign quite likely is.

    I find the fathers statement that their kid: "I mean I don’t even know if she understands our faith. That demonstrated she was ignorant about it." Is a huge red flag. A 12 year old who probably went to church and likely Sunday school would not understand basic Catholicism? Possible but doubtful.

    I also think the very strong statement from the school is important. Someone high up had to approve that message and well knows that a message that strong, if the suit is successful might very well add another zero on to the judgement. They would have to be quite sure of their standing to do it, or complete idiots...

    then there is your link in [80]. Why would they leave out most of the schools statement that contains the meat of the statement if it is not political?

    There is one person that knows the real reason this is all happening and that's the kid.
