The House January 6th Select Committee Hearings [Episode 7]

After an extended break (which was interrupted by the unplanned sixth of these live hearings), the House Select Committee to Investigate January 6th reconvened today for the seventh such hearing. Today's hearing centered around the violent rightwing militia groups that attacked the United States Capitol, and how they were encouraged to do so by Donald Trump.

At the end of the hearing, Vice Chair Liz Cheney previewed what will be the next hearing (which she promised would happen "next week"), when the committee will walk through Trump's actions on January 6th itself.

There were really four star witnesses today, two of whom appeared live, one of whom appeared on video, and one who remained anonymous, with his voice scrambled electronically -- for his own safety, just like someone testifying at a mob trial.

The first segment of the hearing had no live witnesses, instead it heavily featured the very recent testimony given by Pat Cipollone, a White House lawyer for Trump. In earlier hearings, Cheney had publicly pleaded with Cipollone to appear before the committee, so the fact that he was convinced and did appear is a big accomplishment for Cheney, the committee, and the American people as a whole.

The other star of the hearing didn't appear as frequently, but told a fascinating story nonetheless. An anonymous ex-employee of Twitter testified how he had tried to get the company to realize the danger of the situation developing around January 6th, apparently to no avail. Twitter, along with Donald Trump, knew what could happen and they allowed it to go forward without lifting a finger.

The second segment of today's hearing eventually did swear in two witnesses: Jason Van Tatenhove, the former media director of the Oath Keepers militia, and Stephen Ayres, a Trump supporter who entered the Capitol with the mob on January 6th. Their testimony spoke directly to what Trump supporters were thinking when he would tweet directions to them -- both to gather in Washington on January 6th and also (eventually) to go home and leave the Capitol.

Today's hearing was one of the longest yet, clocking in at almost three hours. So I'm going to try to get through everything, but in rather abbreviated fashion.

 

Public Hearings of the Select Committee to Investigate the January 6th Attack on the United States Capitol [Episode 7]

Committee Chair Bennie Thompson began by introducing today's main presenters and questioners, Representatives Jamie Raskin and Stephanie Murphy. After a quick opening statement from Thompson and Cheney (who was trying not to spike the football too much about the fact that Pat Cipollone had been convinced to testify), the main presentation began.

The first subject was the "unhinged, not normal, and the craziest meeting of the Trump presidency" that took place at the White House on December 18th, where Michael Flynn, Sidney Powell, and the guy from Overstock.com all somehow weaseled their way into the White House and got to meet personally with Donald Trump (which actually kind of surprised them). This meeting lasted an astonishing six hours, moving from the Oval Office to the president's residence at some point. The "crazies" were pushing Trump to order the federal government to seize voting machines, based on several crackpot conspiracy theories (but zero evidence). This was all only briefly touched upon, here at the start.

We then got a number of people either stating publicly (at the time) or telling Trump that he had indeed lost the election and that it was time to concede. Pat Cipollone made his first appearance (on video) saying that Trump should have conceded. Others were shown as well: Mitch McConnell speaking on the Senate floor ("The Electoral College has spoken. So today I want to congratulate President-Elect Biden."), Bill Barr, and even Ivanka Trump.

Returning to the 12/18 meeting, we learned that Trump had drafted an executive order which would have stated: "effective immediately, the Secretary of Defense shall seize, collect, retain, and analyze all [voting] machines." This would have been a de facto military coup. Sidney Powell was supposed to be named "special counsel" and would have been in charge of all this, but (luckily) she didn't have a security clearance. Trump tried to just wave a magic wand and appoint her, but this never actually happened (there was no follow-up by anyone, in other words). Here's how Cipollone reported responding to all of this:

I was vehemently opposed. I didn't think she should be appointed anything.... To have the federal government seize voting machines? It's a terrible idea for the country. That's not how we do things in the United States. There's no legal authority to do that. I don't understand why we have to tell you why that's a bad idea. It's a terrible idea.

Please remember, "White House Counsel" means a lawyer whose client is the American people, not the sitting president. Cipollone obviously took this (and his oath to the Constitution) seriously.

The group kept trying to convince the White House people present (other than Trump, who needed no convincing) that there had been massive election fraud -- but they couldn't produce any evidence whatsoever of this massive fraud, other than "a handful of dead people from several states." Cassidy Hutchinson was shown in video summing it all up: the goal was "to keep Trump in office," using any "constitutional loopholes" they could find, since they had no actual evidence.

This meeting was pretty obviously a wild one. There were people screaming at each other, calling each other schoolyard names, and even "challenges to physically fight" and "threats of violence." Former White House staff secretary Derek Lyons characterized it: "At times, there were people shouting at each other, hurling insults at each other -- it wasn't just sort of people sitting around on a couch like chit-chatting."

The meeting began without anyone in the West Wing really being aware of it happening. But after a short time, Pat Cipollone "set a landspeed record" getting there, to rein in the craziness. Cipollone testified: "I was not happy to see the people in the Oval Office." Trump, however, was "very interested" in hearing the crazy ideas and conspiracy theories and proposals. Crazy conspiracies like Venezuela meddling (somehow) in the election, and of "Nest thermostats being hooked up to the internet" being used to somehow change votes.

Cipollone kept insisting on seeing some evidence, but the group had no interest in backing anything they said up (since they couldn't, obviously).

In their own interviews with the committee, Giuliani and Powell both prove how seriously deranged they truly were (and still are). Powell admitted she thought that Trump should have fired everyone in the room who was disagreeing with him, for "showing disrespect." Giuliani pushed back against the sane lawyers in his own special way:

I would categorically describe it as: "You guys are not tough enough." Or maybe I put it another way: "You're a bunch of pussies." Excuse the expression, but... I'm almost certain the word was used.

Rudy eventually had to be escorted out of the building, later that night, "to make sure he didn't wander back."

This unhinged and freewheeling meeting had the effect of making Trump angry, and an hour after it broke up (after midnight), Trump tweeted out to his millions of followers: "Big protest in D.C. on January 6th. Be there, will be wild!"

We then got a taste of how this tweet was received, among his most fervent followers. Alex Jones and other media influencers took it as a clear call to arms. This included direct calls to do what happened that day: "We're going to only be saved by millions of Americans moving to Washington, occupying the entire area, if necessary, storming right into the Capitol. If you have enough people, you can push down any kind of a fence or a wall." One YouTube personality predicted: "Red wave, bitch. There's going to be a Red Wedding going down January 6th. There going to be a million-plus geeked-up, armed Americans." [The "Red Wedding" remark refers, of course, to a brutal slaughter which took place at a wedding in the popular television show Game Of Thrones.]

We then heard from the ex-Twitter employee, who first began getting alarmed after Trump, in a presidential debate, called upon the Proud Boys to "stand back and stand by," rather than "stand down." As the anonymous former employee put it: "My concern was that the former president, for seemingly the first time, was speaking directly to extremist organizations and giving them directives. We had not seen that sort of direct communication before, and that concerned me." He also admitted that if Trump had been anyone else, he would have been "permanently suspended a long time ago," instead of being allowed to keep tweeting up until January 8th. Other things revealed: "It felt as if a mob was being organized, and they were gathering together their weaponry.... the leader of their cause was asking them to join him in this cause and in fighting for this cause in D.C. on January 6th as well." One response to Trump's tweet from one of his followers read: "I'm locked and loaded and ready for Civil War Two."

Other homicidal messages on social media were then displayed, including one that called for killing the "very last Democrat." Messages were exchanged suggesting things to bring, like zip-tie handcuffs and body armor. Trump's fan base was whipped into a frenzy by his "Be there, will be wild!" tweet -- just as he had intended.

The committee then took a break, from 2:18 to 2:33 P.M. (Eastern time).

The second half of the hearing shifted the focus to the radical extremist groups that heeded Trump's call. As one witness put it, "nonaligned groups were aligning... armed militias were collaborating with white supremacist groups." This included the Proud Boys, the Oath Keepers, and the Three Percenters, as well as others. This alliance set up an encrypted chat room called "the Ministry of Self-Defense," and they set about plotting and preparing for January 6th. Another group called itself the "F.O.S." or "Friends Of [Roger] Stone," who together with Michael Flynn, were in close contact with these groups. In other words, the groups had access to people who had direct access to Trump.

Trump knew ahead of time that he was going to call on all these armed groups to march on the Capitol. Various people were talking about it in the days before January 6th, saying things like "POTUS is just going to call for [a march to the Capitol] unexpectedly" (which is exactly what did happen). Or: "Ellipse then U.S. Capitol. Trump is supposed to order us to the Capitol." They knew, ahead of time, what Trump planned on doing. This shows the communication flowed both directions, from these groups to the Oval Office and from Trump back down to them, as marching orders. Steve Bannon could barely contain himself, in an address to the Trump followers, on January 5th: "All hell is going to break loose tomorrow. It's not going to happen the way you think it's going to happen. It's going to be quite extraordinarily different."

The night before January 6th, Trump held a meeting in the Oval Office and demanded that one of the outside doors be opened, so he could hear the sounds of a rally being held on Freedom Plaza (a few blocks away). Sarah Matthews summed up Trump's attitude as: "He was in a very good mood. He had not been in a good mood for weeks.... It seemed he was in a fantastic mood that evening." One White House photographer testified that Trump was planning his route out to the Capitol the night before the rally.

We then got some prime craziness from the January 5th evening rally from video taken of the event, with Roger Stone and Michael Flynn saying all sorts of apocalyptic things. We also got Alex Jones leading the crowd in a chant: "1776!... 1776! ... 1776!" Trump later tweeted out: "We hear you (and love you) from the Oval Office."

The anonymized former Twitter employee was heard from next, lamenting the inaction at the company. "When people are shooting each other tomorrow, I will try and rest in the knowledge that we tried," he sent to another person at Twitter who was just as concerned as he was. He also predicted: "If we made no intervention into what I saw occurring, people were going to die.... We were at the whims and mercy of a violent crowd that was locked and loaded."

This part of the hearing ended by revealing how Trump kept pushing to include lines in the speech he would give -- even on the morning of January 6th, right before he delivered the speech to his rally -- which called out Mike Pence and told the crowd to go to the Capitol. Many people pushed back on the inclusion of these lines, but they made it into the final speech. In the prepared speech, Trump would have said these lines once each, but when he spoke it was (as usual) full of ad-libbing, and he actually excoriated Pence eight times and called on the crowd to go to the Capitol four times. Several of these were played on video, including Trump saying: "You'll never take back our country with weakness," and: "We fight like hell and if you don't fight like hell, you won't have a country." He then invited everyone to "walk down Pennsylvania Avenue" with him to the Capitol.

Former Trump campaign manager Brad Pascale shared his concerns about the speech with former campaign advisor Katrina Pierson: "This is about Trump pushing for uncertainty in our country, a sitting president asking for civil war." Pascale expressed his regret and guilt, and Pierson attempted to make him feel better. He messaged her back: "Yeah, but a woman is dead," he replied. "And yeah, if I was Trump, and I knew my rhetoric killed someone...."

At this point, a good 40 minutes in to the second part of the hearing, the two in-person witnesses were sworn in. The first was Jason Van Tatenhove, who previously was the media director for the Oath Keepers, and the second was Stephen Ayres, an unaffiliated Trump supporter who is awaiting sentencing after pleading guilty to entering the Capitol on January 6th.

Tatenhove has broken from the Oath Keepers group, and he testified that they were a "dangerous militia" who recruited "white nationalists" and "straight-up racists." The leader of the group "had these visions of being a paramilitary leader and the Insurrection Act would have given him a path forward with that." They fully expected Trump to invoke the Insurrection Act, which they saw as somehow being deputized into being a sort of palace guard for Trump himself. Their vision for America "doesn't necessarily include the rule of law. It includes violence.... trying to get their way through lies and deceit."

Tatenhove has changed his views, obviously, and he was pretty adamant about sounding the alarm: "We need to quit mincing words and just talk about truths, and what it was going to be was an armed revolution.... There was a gallows set up in front of the Capitol.... it could have been the spark that set off a civil war." He later said: "All I can do is thank the gods that things did not go any worse that day."

Even when he was with the group, there were limits to how far Tatenhove would go, according to him. He was directed to make a "deck of playing cards" of perceived enemies much like the one used in Iraq, composed of American politicians and judges and others who were to be "taken out." Hillary Clinton, Tatenhove said, was going to be the Queen of Hearts. But he refused to do the graphic artwork for the project. He also described how the militia had training courses on how to use explosives, among other things: "There was always a push for military training."

Tatenhove truly fears for what the next election cycle will bring, warning: "We've been lucky," so far. "I think we've gotten extremely lucky that more bloodshed hasn't happened." He now fears another president whipping up a civil war using "lies and deceit and snake oil," because "all bets are off at that point."

He ended with a plea: "I have three daughters. I have a granddaughter, and I fear for the world that they will inherit if we do not start holding these people to account."

Stephen Ayres was presented as a kind of "everyman insurrectionist" -- just a normal "family man, a working man" in his own words. He explained how he got sucked into all the conspiracy theories and Trump's Big Lie: "I was pretty hard-core into the social media." So he decided to join a few friends who were planning on going to D.C. for the January 6th rally.

When questioned, he admitted that he "was very upset" because he believed Trump when he said the election had been stolen. He no longer believes this (or "not so much"), because he did his own research and came to the conclusion: "It's too big, there's no way you could keep something like that quiet." When Liz Cheney asked him whether it would have made a difference if he had known that Trump had no evidence, he admitted he probably wouldn't have made the trip if he had known that: "Who knows? I may not have come down here then."

On January 6th, he attended Trump's rally. "We didn't actually plan to go down" to the Capitol, but "basically the president got everybody riled up and told everybody to head on down -- we basically were just following what he said." He fully expected Trump to march with them or appear at the Capitol -- again, because that is exactly what Trump promised from the stage.

The most interesting thing Ayres had to say -- something which will undoubtedly come back up in the upcoming hearing into Trump's actions that day -- was how Ayres described the crowd inside the Capitol finally receiving Trump's tweet calling them to go home: "As soon as that came out, everybody started talking about it. Basically, when President Trump put his tweet out, we literally left right after that. If he would have done that earlier in the day... maybe we wouldn't be in this bad of a situation." He said much of the rest of the crowd immediately left as well, after reading Trump's tweet. This proves more than anything else in these hearings the power of what Trump could have done at any earlier time during that day.

Ayres ended by telling the committee what has happened to him since: "I lost my job... I sold my house... [it] changed my life, not for the good, definitely not for the better." He expressed anger that Trump is still promoting his Big Lie. He ended by being asked what lessons he had learned: "I love my family. I love my country.... I don't think any one man is bigger than any one of those." He also called upon other Trump supporters to "take the blinders off, step back and see what's going on, before it's too late."

 

Conclusion

There were a number of things worth noting from the closing statements. Jamie Raskin could barely contain his anger at Trump, stating that Trump had ushered in the phrase he infamously used in his Inaugural Address: "American carnage." Raskin pointed out:

That's Donald Trump's true legacy. His desire to overthrow the people's election and seize the presidency interrupted the counting of Electoral College votes for the first time in American history, nearly toppled the constitutional order and brutalized hundreds and hundreds of people.... The Watergate break-in was like a Cub Scout meeting compared to this assault on our people and our institutions.

Stephanie Murphy's closing statement was also powerful, in a different way. She pointed out that she was not born in America, she was born in Vietnam and her family fled the country as refugees during the Vietnam War. She has personal experience, she said, fleeing a country where people grab power using violence, and then she wound up fleeing her fellow citizens when they attacked the United States Capitol. "I love this country" she poignantly said, saying she wanted to preserve "what actually makes America great."

Liz Cheney had the big surprise, at the end. But first, a word about her opening statement. In it, she used a legal term that could come up if Donald Trump is ever tried for any of his crimes against the country:

The strategy is to blame people his advisers called "the crazies" for what Donald Trump did. President Trump is a 76-year-old man. He is not an impressionable child. Just like everyone else in our country, he is responsible for his own actions and his own choices.... No rational or sane man in his position could disregard that information and reach the opposite conclusion. And Donald Trump cannot escape responsibility by being willfully blind, nor can any argument of any kind excuse President Trump's behavior during the violent attack on January 6th.

Legally, being proven "willfully blind" -- refusing to believe the truth -- is the same thing as knowing something is true.

In her closing statement, Cheney (as she has been doing) previewed the next hearing, which she said will take place "next week." This hearing will examine pretty much on a minute-by-minute basis exactly what Donald Trump did and did not do on January 6th. Which will be the final piece of the puzzle (she didn't come out and say it, but this sounds like the last hearing that will be centered on presenting new evidence).

Cheney's bombshell, at the very end, was in keeping with everything everyone knows about Trump and his mobster tactics -- Cheney stated that a witness who has not testified in any of these hearings yet just got a phone call from Trump within the last week. The witness refused the call and called their lawyer instead. Cheney ominously warned that she had referred the matter to the Department of Justice, since witness-tampering is a federal crime.

Just when you thought Trump's thuggishness couldn't get any lower, it always seems to. That was an entirely fitting end for today's hearing.

    And MANY of those angry voters will be Democrats! :D

    Biden's Handlers have indeed united the country.. He has united the country AGAINST him and the Democrat Party..

    Her Trump/America hate and her PTDS have consumed her...

    And, in the end, she will be left with nothing...

    She might as well run as a Democrat for all the good it will do her..

    The Two Weeks Late Presidency

    It’s a pattern.

    Two weeks after the Supreme Court eliminated the constitutional right to an abortion, three months after a draft of that opinion leaked to the press, and nearly two years after a Ruth Bader Ginsburg’s death made the elimination of that right more likely than not, President Joe Biden entered the chat.

    Describing the Dobbs decision as “an exercise in raw political power” from an “out of control” court, Biden on Friday signed an executive order that would safeguard certain reproductive health services, protect patients’ private medical records, form an interagency reproductive health care task force, and more. The administration is said to be considering declaring lack of abortion access a public health emergency, too, in a mostly symbolic move.

    It was Biden’s first appearance since the Dobbs decision where he showed some of the fire that a change of this magnitude merited.
