The House January 6th Select Committee Hearings [Episode 9]
The House Select Committee investigating January 6th presented the ninth in their series of televised hearings today, although (as we were informed at the start by Chair Bennie Thompson) this was not technically a hearing, but rather a business meeting for the committee. The reason for this change became evident at the end, when the committee voted publicly and unanimously to subpoena the testimony of Donald John Trump.
That was certainly a blockbuster or a bombshell (take your pick of explosive metaphors), and it is to the committee's credit that they kept it under wraps until today.
Today's hearing was billed as the culmination of the committee's entire presentation to the public. As always, they have left the door open to hold future public hearings, but the expectation is that this will be the final one. At the very least, there are no more hearings scheduled before the midterm elections -- which will determine the future of the committee itself. If the Republicans manage to take back control of the House, then one of their first orders of business is going to be to disband the committee.
Knowing this, the committee is preparing a final report, which will likely be issued somewhere between Thanksgiving and Christmas. Their initial intent was to provide some sort of draft report before the election happened, but that is now not going to happen.
So today was it, really, barring any unforeseen evidence suddenly coming to light.
Public Hearings of the Select Committee to Investigate the January 6th Attack on the United States Capitol [Episode 9]
Today's hearing started rather slow and it took over an hour before they even really start charting any new territory in any meaningful way. Perhaps the committee is a bit rusty, since the last of these hearings was held before the August congressional break, almost three months ago. Or perhaps they felt that people needed a summary refresher course in what they've already laid out.
Today's hearing also felt a lot more like a traditional congressional committee hearing, at least in format. Rather than choosing only one or two of the committee members to make the presentation, all nine got a chance to speak at length. This took up almost all the time of the hearing, although the chair kept referring to each segment as "opening remarks." Also today there were no live witnesses at all, just video clips of (mostly) previously-seen testimony from Trump insiders.
Today's hearing was focused almost solely on Donald Trump. It was, in a word, very prosecutorial. The opening recap wasn't so much about everything the committee has learned and uncovered as everything they now know about Trump. This all had a purpose -- to show what Trump knew, what he believed, and that the plan for January 6th itself was entirely premeditated. It wasn't some spontaneous thing that happened, it was the culmination of a lot of planning beforehand. Planning which took place even before Election Day, in fact. Trump was always going to declare himself victor, no matter what the voters had to say about it. From that point on, Trump grasped at any straw which might somehow magically keep him in power, and the January 6th plot was merely the last straw available. But it was all planned in advance, each and every step of the way.
Trump knew he had lost. That was the other theme laid out in the early presentation. Everyone within his government and his campaign told him so, and on occasion he would even admit the truth. All the lawsuits went against him, since there just was no evidence of any fraud large enough to have made a difference in even a single state. And yet, even knowing all this, Trump still stoked the rage of his followers -- and indeed, continues to do so even to this day. It makes him lots of money, after all, so why should he stop?
The committee walked everyone through the story once again, beginning before the election and ranging over the night of the election, the post-election lawsuits, the fake electors scheme, and the last-ditch effort to stop Congress from certifying the election results on January 6th. Each piece was individually presented, with Trump at the center of everything that took place.
Even while Trump was doing all this, proof was presented that he knew he was going to have to leave office on January 20th. He signed a reckless order to the Pentagon for them to pull all American troops out of Somalia and Afghanistan "by January 15th." The generals somehow (it was not specified) managed to ignore this rash and very political order, but the point was that Trump never would have given it if he thought he truly was going to stay in power.
Trump's rage was referenced multiple times, the first manifesting itself as his reaction to the Supreme Court ruling against his bogus election fraud case. This (and other incidents) were fleshed out in a lot more detail, due to the committee finally getting "over one million" communications from the Secret Service from this time period. The text messages are gone forever, but plenty of other types of message do remain and were made available.
The Secret Service did not exactly shine in today's hearing. It was revealed that they actually were warned in advance that there would be armed rioters present, and that the Capitol was definitely the target of the planned attack. They knew this much earlier than had been previously admitted. These threats were specific ("Their plan is to literally kill people. Please please take this tip seriously and investigate further.") and very numerous, and the Secret Service and others in federal law enforcement were indeed tipped off about them beforehand. Astonishingly, even though they knew of this threat, there was still no plan for what to do about it on January 6th. There was no "worst-case scenario," there were no contingency plans
Both the Secret Service and Trump himself knew on January 6th that there was a huge crowd who didn't want to go through metal detectors in order to watch Trump's speech. Trump didn't care that they were likely armed, he begged the Secret Service to just turn off the metal detectors and let them in anyway.
The Secret Service did not do so, and they also prevented Trump from making good on his wish (and promise, in his speech) to walk down to the Capitol with the mob, and got quite irate when told he couldn't do so. Those are about the only two good things that can be said for the Secret Service on that fateful day. It was insinuated today that some people (the Secret Service was not directly named, but implied) have probably lied to the committee under oath, and that the committee would be dealing with that in due course.
But back to Trump. Donald Trump knew all his claims of fraud were false. He was told so, by many people, on many different occasions. He didn't care. He knew claiming specific instances of fraud whipped up the crowds, so he just went right on making these specious claims, even after they were all proven to be false -- to him personally, by multiple advisors. He also leaned on state officials to break their oaths of office and just somehow magically hand the election to him. He knew about the plan to present "fake electors" on January 6th, although this never actually took place due to Mike Pence actually upholding his oath to the U.S. Constitution.
The White House was informed that the Capitol had been breached before Trump even made it back there from the rally. When Trump was informed of this fact, he withdrew into the dining room and watched it all on television for the next two hours and 40 minutes. Plenty of people visited him while he was watching the attack unfold live (on Fox News, one assumes), and they all begged him to issue a public statement calling off the rioters and telling them to go home.
Trump refused to do so. He also, as the committee detailed in an earlier hearing, refused to lift a finger to do anything at all to defend the building and all the congressmen trapped inside. He did not call the Pentagon, he did not call his attorney general, he did not call the National Guard, he didn't call anybody with the authority to send in additional forces to defend and protect the United States Capitol. Instead, he did nothing. He watched television.
At one point, Trump actually made things worse, by directing the crowd's anger at his own vice president, Mike Pence. He not only instigated the riot, he further incited it even after it had begun. One can only imagine what he would have done or said if he had been allowed to walk down to the Capitol with his mob. Maybe he would have led the chants of "Hang Mike Pence!" -- it is certainly possible to picture him doing so.
The biggest new video evidence of the day showed that while Trump was sitting on his hands, others were desperately trying to get some troops to the Capitol. Behind-the-scenes footage from the secure locations where the congressional leaders had been taken was shown, and we all got to see Nancy Pelosi, Chuck Schumer, Mitch McConnell, Steve Scalise, John Thune, and others from both parties absolutely begging for the cavalry to be sent in. They phoned the Pentagon, the Department of Justice, the governors of Maryland and Virginia, the vice president, and anyone else they could think of who might be able to get the ball rolling.
In essence, they did Trump's job for him that day. Because all they got from the White House was a gigantic dereliction of duty.
The most jarring clips came from Nancy Pelosi. At one point, when informed that the House was actually in session, but that they were being instructed to don gas masks on the House floor, she muttered: "Can you believe this?" This summed up most Americans' feelings of disbelief that day, that things could have reached this point.
Here is Pelosi on the phone, trying to figure out if Congress will be able to reconvene any time soon, so they could finish their constitutional duty of certifying the presidential election:
What we are being told very directly it's going to take days for the Capitol to be okay again. We've gotten a very bad report about the condition of the House floor. There's defecation and all that kind of thing as well. I don't think that that's hard to clean up but I do think it is more from a security standpoint of making sure that everybody is out of the building and how long will that take. I just got off [the phone] with the Vice President, but what we left the conversation with, 'cause he said he had the impression from Mitch [McConnell] that Mitch wants to get everybody back to do it there. I said that, well, we're getting a counterpoint that it could time to clean up the poo-poo that they're making all over the, literally and figuratively, in the Capitol. And that it may take days to get back.
It didn't, in the end. After reinforcements did finally arrive and the building cleared, Mike Pence informed Pelosi that the building would be ready "in an hour," and Congress was indeed able to reconvene and complete its duty.
The clips with the congressional leaders were the centerpiece of today's presentation. The rest of the hearing was really intended to build up to them. There were smaller revelations here and there -- new video testimony from some of the key players -- but for the most part it was all a review of previously-presented information. The buildup to the new clips had the flavor of a class during the first week back at school, when the kids are all reminded of everything they've managed to forget over the summer.
Structuring the final hearing in this fashion left a lot of unanswered questions, of course. No testimony appeared from Ginni Thomas, or from cabinet-level people who reportedly discussed invoking the 25th Amendment to remove Trump from office before January 20th. There was no further examination of the breakdown in communications and orders and planning at the Pentagon (the complete absence of the D.C. National Guard, for instance). There was no deeper dive into the financing of the January 6th rally or the connection to the Proud Boys and the Oath Keepers. Assumably, this will all be covered in the report, but the report won't be out until after the midterms.
Instead of covering any of this new ground, the Select Committee essentially laid out an indictment of Donald Trump, from beginning to end. They finished today's meeting by concluding that they needed to hear from Trump himself. Liz Cheney stepped in to make a formal motion to issue a subpoena for Trump's testimony, the clerk read the motion in full, and the committee immediately voted on it.
The vote was unanimous, with each committee member answering "Aye" when asked whether the committee should issue a subpoena to Trump.
This was the big finale, and the hearing ended immediately thereafter.
Conclusions
As television, today's hearing was not as dramatic as the previous hearings have been, even with its big finish at the end. It was mostly just a review of ground they've already covered, presented as a narrative solely centered around one individual. It all built up to the bombshell of subpoenaing Trump.
The committee, of course, has no power to indict or to try any crime. Making a formal criminal referral to the Justice Department would be a largely meaningless thing to do, since they are already diligently looking into it all. It would have no effect except maybe to say: "Please keep doing what you are already doing," in essence.
The committee itself may turn into a pumpkin in January, if the Republicans take back control of the House. There will be no time for extended litigation if Donald Trump decides to fight the subpoena. Even if the Democrats do manage to hang onto power, Trump might just fight the subpoena for so long (filing time-consuming ridiculous motions and appeals all the while) that the legal battle wouldn't even be concluded after two more years.
The subpoena itself is symbolic, for the most part. As both Bennie Thomas and Liz Cheney stated, they feel that the American public deserves to hear from the man at the center of it all what happened on January 6th and everything that led up to it. They feel that accountability demands Trump tell his side of the story. Even while knowing it'll likely never actually happen.
This entire exercise has a political symbolism to it, but it is also a huge taunt to Trump himself. Trump knows full well that if he did show up to testify, it would send the television ratings through the roof. And he loves to be the star of his own show (or anyone else's). And he has had to get used to reaching a smaller and smaller audience with his online ranting. So who knows, maybe he'd be tempted?
Which brings us to this tantalizing report to end on, which appeared soon after the hearing concluded. This was posted by the best Trump reporter around, Maggie Haberman from the New York Times, who obviously has some inside sources:

With Trump, one just never knows what he'll do next. It would be fascinating to see him take this bait. And if he's really determined, perhaps none of his advisors or aides can talk him out of it. So maybe this won't be the last of the Select Committee's televised hearings?

After running a background check without a permissible purpose, a police officer faces a serious criminal charge.
The Story
A police officer in Peoria, Arizona stands accused of wrongfully running a background check on a citizen. Allegedly, the officer agreed to look up information about a woman at the request of a friend. This friend was reportedly interested in dating a co-worker but first wanted to know if she has a criminal record.
The officer allegedly provided a completed background report to his friend. After reviewing, that friend approached the woman he hoped to date and referenced a personal experience which he should not have known. When asked how he got that information, the man shared the story of what happened.
Soon after, the co-worker called local police and filed a complaint.
Officers are permitted to run license plates while on active duty, but they are not allowed to run background checks on individuals without cause. The officer who stands accused of running an unauthorized background report faces a class six felony charge. He was placed on administrative leave and later resigned.

After running a background check without a permissible purpose, a police officer faces a serious criminal charge.
The Story
A police officer in Peoria, Arizona stands accused of wrongfully running a background check on a citizen. Allegedly, the officer agreed to look up information about a woman at the request of a friend. This friend was reportedly interested in dating a co-worker but first wanted to know if she has a criminal record.
The officer allegedly provided a completed background report to his friend. After reviewing, that friend approached the woman he hoped to date and referenced a personal experience which he should not have known. When asked how he got that information, the man shared the story of what happened.
Soon after, the co-worker called local police and filed a complaint.
Officers are permitted to run license plates while on active duty, but they are not allowed to run background checks on individuals without cause. The officer who stands accused of running an unauthorized background report faces a class six felony charge. He was placed on administrative leave and later resigned.
