I just spent a few hours watching the Electoral College vote. Now, admittedly I am a pretty wonky political guy, but I have never before paid even the slightest attention to the formality of each state's electors meeting to cast their official ballots to elect the next president. It was always an afterthought, a mere formality. Something you'd hear about maybe a day or so after it happened, because it was of no real consequence. Even in the midst of the 2000 Bush v. Gore fight, nobody really paid much attention to the Electoral College, because it simply wasn't all that relevant to the legal fight.

President Donald Trump has gotten away with all kinds of things while in office, blowing apart many traditions, conventions, and presidential precedents. He has gotten away with it, for the most part, because very little of it is actually written into law. They're all just a sort of an unwritten code of conduct that previous presidents have all (mostly) followed. But if Democrats do win the "trifecta" next Tuesday and wind up in control of both houses of Congress and the White House, they will be in a position to do something about this sorry state of affairs, in order to prevent any future presidents from getting away with such egregious behavior.

Speaker of the House Nancy Pelosi has announced that the House will soon be moving forward on a bill to rein in the presidential pardon powers, to avoid any future president being allowed to do what Donald Trump just did -- abuse this power to grant clemency for a person convicted of lying and witness tampering to protect Donald Trump. A clearer abuse of power would indeed be hard to imagine, unless it was Trump attempting to proactively pardon himself for any and all federal crimes he's ever committed. Which, at this point, isn't outside the realm of possibilities, for Trump. But while Pelosi will be making a little political hay out of the issue, she is actually aiming too low. Because what is really needed is a constitutional amendment.

For the first time since 2004, Democrats are united in the spring of a presidential election year. The primary season is essentially over, with only one candidate left standing. All the other candidates of note have now endorsed presumptive nominee Joe Biden. This is downright remarkable when you consider where we were just a few short months ago.

This means they want to be told the truth, they want to see the president and those around him working as hard as they can to improve things for everyone, and they want to see mistakes quickly rectified and problems that pop up addressed and ultimately solved. Throughout the presidency of Donald Trump there have been many weeks that have left everyone completely exhausted, because so many momentous events have happened with such blinding speed. Each time, it's been tempting to say: "Trump can never top that week" at the end of it. We've all but given up doing so, because no matter how intense things get, there always seems to be a way to ratchet things up the very next week. However, that temptation was almost overwhelming this particular week.

As I sit down to write my reactions to the State Of The Union speech and the Democratic response, votes from Iowa are still trickling in. That's a rather bizarre overlap, caused by the total breakdown of the Iowa Democratic Party's reporting system. The spectacular failure of the whizzy new app taken together with the equally spectacular failure of the backup phone hotline reporting system meant it was almost 24 hours from when the caucuses started to when any results were made publicly available. And the only saving grace was that there was indeed a full paper trail to follow, so the votes themselves (we are assured) will all be counted accurately.

As of this writing, nothing has been officially decided yet in the Senate impeachment trial. However, one thing seems almost certain at this point: there will only be 49 votes, maximum, in favor of calling witnesses. Both Lisa Murkowski and Lamar Alexander have announced that they will not be voting for witnesses, which leaves all 47 Democrats together with only Mitt Romney and Susan Collins. Murkowski may have been persuaded to vote no because if she had voted yes it would have set up an uncomfortable situation for Chief Justice Roberts, who would have to decide whether to break a 50-50 tie or not (with the safe money being on "not"). In any case, that's how things stand as I begin writing this.

Some constitutional history was made this week -- and it had nothing to do with President Donald Trump, because presidents have absolutely no role in amending the Constitution itself. That power is reserved to Congress and the legislatures of the states. And Virginia's state legislature just officially ratified the Equal Rights Amendment. In doing so, they became the 38th state to ratify, which seems to meet the constitutional requirement that three-fourths of the states ratify an amendment in order for it to be adopted as part of the Constitution. This is a fairly momentous occasion, which coincides with the other constitutional history being made in the Senate this week, as only the third-ever presidential impeachment trial continues.
